Milwaukie man arrested for allegedly assaulting Capitol police with chemical spray during Jan. 6

The 27-year-old Andy Steven Oliva-Lopez, who was identified in footage on the Capitol grounds clashing with officers, was arrested by the FBI on Tuesday.

MILWAUKIE, Ore. — A Milwaukie man was arrested Tuesday for multiple charges relating to his role in the Jan. 6 Capitol riot.

The 27-year-old Andy Steven Oliva-Lopez was arrested by the FBI. The Portland and Washington FBI offices had identified him in video footage and images on the west front of the Capitol grounds, clashing with officers from the Metropolitan Police Department (MPD) and United States Capitol Police.

Around 2 p.m., Oliva-Lopez "deployed a yellow/orange-colored chemical aerosol multiple times at individual MPD officers," striking at least one officer in the face shield, according to the U.S. Attorney's Office for the District of Columbia. Oliva-Lopez then climbed past temporary scaffolding for the upcoming presidential inauguration, located inside a restricted area.

According to a federal affidavit, phone records show Oliva-Lopez was in D.C. in the days leading up to the Jan. 6 riot. Just prior to that, bank records also show multiple purchases along Interstate 80, suggesting a cross-country trip.

Bank statements also showed the purchasing of two canisters of bear spray at a Portland sporting goods store two weeks before Jan. 6, likely the spray he's accused of using on Capitol officers.

His charges include felony offenses of civil disorder and assaulting, resisting or impeding officers. Oliva-Lopez also faces charges of misdemeanor offenses of "disorderly and disruptive conduct and act of physical violence in a restricted building or grounds and act of violence in a Capitol building or grounds," according to the U.S. Attorney's Office for D.C. 

The case is being prosecuted by the U.S. Attorney’s Office for D.C. and the Department of Justice National Security Division’s Counterterrorism Section. 

More than 1,265 people have been charged in nearly all 50 states relating to the Jan. 6 riot, said the U.S. Attorney's Office for D.C.
